The Supreme Court has upheld the conviction of Francis Atuche, the former Managing Director of the defunct Bank PHB Plc, after approximately 13 years of trial.
In the unanimous judgment delivered by Justice Moore Adumein on Friday, June 28, the Supreme Court determined that Atuche failed to overturn the findings of the trial court and the Court of Appeal regarding his credibility.
The court emphasized that when the decision of a trial court concerning the demeanor of a party or witness is corroborated by documentary evidence, an appellate court should not interfere with that decision.
Ultimately, the court concluded that Atuche had not provided sufficient grounds to challenge the concurrent findings of the two lower courts.
