An Otuocha High court, Anambra East Local Government Area, Anambra state, presided over by Hon. Justice D O C, Amaechi, has ordered the Inspector General of Police, IGP, Mr. Solomon Arase, Anambra state Commissioner of Police, Mr Horsea Karma and four others to stop forthwith the arrest of Uruebo Nkwelle-Ezunaka youths over land crises.
The order was sequel to the motion ex parte filed by the youths’ chairman, Tony Okafor and nine others (plaintiffs) against the police, Charles Obimma who is the embattled chairman of the community and Emmanuel Anyakora (defendants) praying the court for an interlocutory injunction restraining the defendants, their agents, privies, or officers from arresting, detaining or threaten them with any other act tantamount to an infringement of the fundamental rights of the plaintiffs.
After hearing the prayers of the plaintiffs through their counsel, Chief C. E. Eregbuonye who was represented by S C Onyendilefu, the judge granted their prayers.
The judge on making the order said, “upon reading the application by motion exparte, the accompanying 28 paragraph affidavit of urgency, 21 paragraph affidavit in support of motion exparte both sworn to by one Tony Okafor and written address, all filled on 17th March, 2016, it is ordered that the plaintiffs’ should not be arrested, detained or tortured by the defendants pending the determination of the substantive suit”.
The matter is adjourned to 17th of May 2016 by the judge.
